WEDDING CAKE CONTRACT
___________________ and Creme de la Creme agree as follows: (Client)
1. EVENT and DATE: Creme de la Creme shall provide the cake for your
wedding / event on _________ (“Event”) at ______________________ . (date) (location)
2. PROJECT DESCRIPTION: The cake to be provided by Creme de la Creme is described in the attached order. Any changes to this order must be made no later than five (5) days prior to the event date. Any changes made less than five days prior to the event date cannot be guaranteed and will only be made at additional cost.
3. PAYMENT ARRANGEMENT: To secure your event date, Creme de la Creme will decline other work. Accordingly, you agree to the following payment arrangement:
· A deposit of 50% of the total contract price is due upon signing this contract, of which $50.00 is non-refundable. · The remainder of the total price shall be due five working days before the Event. · Credit card payments are welcome. However, an additional three percent (3%) surcharge will be added to any payment made by credit card. · In the event of payment by credit card, we will charge 50% of the contract price upon signing of the contract, and the remaining 50% balance due will be charged to your credit card seven (7) days prior to your event. · If you are renting any items from us, there will be a $_________ deposit. Any rental items must be returned by Wednesday of the week following your event date or your deposit will be retained.
4. LIABILITY: You agree to assume full responsibility for your wedding guests and agree to indemnify and hold Creme de la Creme harmless from and against all bodily injury, property damage or consequential damages which may result from Creme de la Creme's services and provision of your wedding cake.
5. ATTORNEY'S FEES: In the event that you fail to pay Creme de la Creme and collection procedures are initiated, you will be responsible for Creme de la Creme’s reasonable attorney's fees and costs, including on any appeal. Venue for any such action shall be in King County, Washington.
6. ACTS OF GOD: Creme de la Creme‘s obligation to perform will be modified to the extent necessary based on transportation problems, delays in product delivery, inclement weather, acts of God, or other causes beyond Creme de la Creme’s control that make it impossible or impractical for Creme de la Creme to perform.
7. USE OF PHOTOGRAPHS: On occasion, Creme de la Creme will take photographs of its cakes or may order copies of pictures from your photographer. We reserve the right to use any photographs for our own reference or for display and/or promotion without compensation to you.
We at Creme de la Creme appreciate your willingness to follow these few provisions. They exist to insure that you experience a wedding day with truly unique cake designs created especially for you and the style of your wedding.
